North Carolina law requires real estate agents to disclose their agency relationship before you share confidential information. Please review the types of agency relationships available to you.
Types of Agency Relationships
Seller's Agent
We represent the seller and owe fiduciary duties to them. We are still honest and fair with buyers, but our primary obligation is to the seller.
Buyer's Agent
We represent you as the buyer — helping you find property, negotiate on your behalf, and protect your interests throughout the transaction.
Dual Agency
When we represent both buyer and seller in the same transaction. Dual agency requires informed written consent from both parties. You always have the right to decline dual agency and seek independent representation.
Buyer Agent Compensation (Post-August 2024)
As of August 17, 2024 (NAR Settlement), buyers must sign a written Buyer Agency Agreement before touring homes. This agreement specifies the compensation the buyer's agent will receive and whether it is paid by the seller, buyer, or both. Compensation is always negotiable.
Your Rights
- You always have the right to choose your own representation.
- You have the right to ask about agency relationships before sharing any confidential information.
- You may decline dual agency at any time.
